Dear MP,
Many thanks for your response to my letters and I welcome your obviously
educated stance on many of the issues I raised and completely agree
with you about the dangers of allowing ISPs to prioritise traffic based
on commercial reasoning and ensuring the service they provide is done so
transparently.
I would comment however that you may be misinformed about all networks
shaping their traffic and what QoS (Quality of Service) actually does to
network traffic compared to network management using hardware. There is
a huge difference between managing your network traffic with
strategically placed IP blocks for customers that mix heavy bandwidth
users with light ones at an Exchange level and shaping the traffic using
‘intelligent’ monitoring software that filters and prioritises data
within.
I grant you that a number of the larger broadband ISPs (BT, Virgin to
name a few) do currently traffic shape in a "don't be evil" fashion,
giving priority to VOIP traffic and throttling traffic evidently torrent
or other file sharing applications in an attempt to maintain stability
on their already oversubscribed networks, but not all ISPs take this
approach. Both Be and Sky broadband provide services that are not
traffic shaped, have no Fair Usage Policy and are synced above the rate
the BT Exchange will quote, to name two networks I have dealt with
directly.
Generally I have found that the larger the company, the more likely they
are to shape their traffic and this isn’t done to benefit the
customers, it is done purely to ensure they can continue to provide a
service they have offered but cannot feasibly deliver with their current
infrastructure.
I would also argue that the prioritisation of any internet traffic is a
contentious point that is already heading down an ugly road if it is
allowed to go on unregulated; how can any ISP realistically tell me my
own personal traffic is less important than the lady next doors’ VOIP
call to her friend in Australia unless they deep packet inspect it,
again a very suspect practise?
It is my own opinion that a lot of ISPs are so used to providing much
less service than they advertise and have increased their contention
ratios on their networks to reflect this. They are now beginning to
panic and try to work out how they can extract more cash from anyone
they can to maintain the high dividends they were paying when we, as a
society, were getting used to email and didn't know what a “Facebook”
was (sic). Now in our much more modernised and technology orientated
society, they are slowly realising they cannot fully provide the service
levels they advertise (like 'UNLIMITED' packages that actually mean
30GB of data transfer a month). Several years ago this would have been a
wealth for the average Silver Surfer but with an ever increasing amount
of devices that can connect to the internet to access services like BBC
iPlayer, 4OD, Xbox Live, Apple TV, etc, etc, the general population are
becoming ever more hungry for bandwidth.
It is also the opinion of Ofcom chief executive Ed Richards, admitting
in July of this year that for the first time yesterday ISPs have been
selling consumers broadband speeds that they couldn’t possibly achieve.
It is very hard to find a word for these companies other than blatant
liars. Yet what other word could you use to describe an entire industry
that has systematically misled the public for years?
It is on this basis I question how we can trust these companies to self
regulate. Their aim is to capitalise on services they cannot possibly
provide and traffic shaping, none neutral network plans and double
dipping on service agreements between themselves and backbone providers
of data is how they will continue to maximise revenue rather than use
the revenue that should have been set aside to upgrade their networks to
the capacity they have been promising and ‘providing’ for years.
BT, the biggest offender of all ISPs, even tried to commercialise a
product based on Deep Packet Inspection called Phorm (a subject I wrote
to Michael Jack MP about last year) in which they conducted an illegal
trial on 10,000 customers with their web interception and profiling
technology which would allow third parties to inject advertising content
based on compatibility matching, arguing they were unaware they were
intentionally breaking the law (since when has that been a valid
excuse?) and that users were going to be able to opt-out, again not a
legal practise.
It is with keeping the internet as open and innovative as possible that I
plead with you to ensure that ISPs are not allowed to neuter the
internet with none neutral networks and pave the way for more
profiteering by ISPs, less reason for BT to upgrade the contention
ratios on their networks to ones that can realistically cope with the
demand and placing the internet in the hands of those with the biggest
budgets to deliver their content.
In reference to my comments on pornography, I welcome you to forward my
letter to Lynne Featherstone MP and appreciate rational debate on
protecting children directly rather than indirectly censoring things
that are subjective.
I also very much appreciate your willingness to understand that when a
review by educated peers conclude it, that advice is actually learned
from. With that in mind I might recommend that the current government
take a leaf out of that book when dealing with drug policies in future.
To refer to recent comments by the Crime Prevention Minister James
Brokenshire, on behalf of the government, said:
"Removing the requirement on the home secretary to appoint to the
Advisory Council on the Misuse of Drugs at least one person with
experience in six specific areas will allow us greater flexibility in
the expertise we are able to draw on."
I wonder though, in what scenario wouldn't you want a medical doctor or
pharmacist to give scientific advice on the misuse of drugs? If there is
one thing that politicians can and should do to limit the damage caused
by illegal drugs, it is to take careful note of the evidence and
develop a rational drug policy. Once again I am not trying to
rationalise the recreational use of drugs, I would like to bolster
common option and prejudice with facts before a decision is made.
Whilst the topic of drugs does not directly affect me, the premise of
removing science from decision making in Government not only scares me,
it begins to pave the way for other topics to be ill-advised and
decisions made on speculation rather than facts, drawing me back to my
original point in a roundabout way.
A society ran on the whims of its ruling masters who elect boards of
advisers that are positioned within it to give them the answers they
want to hear is not one I would imagine the general public would care to
be part of, and sounds more like something out of a certain George
Orwell novel than the rational and reasoned decisions of those in charge
of our Democratic society.

It is often I conclude it is down to my own inexperience that certain
decisions within government seem illogical, certainly true of the
previous ‘Government’. Having more than ten years of commercial
experience online and wealth of computing qualifications, it seemed
poignant that I question these decisions. My hope is to try and ensure
that the outcome be of interest to the nation regardless of their own
understanding of the topic and not just a select group of greedy
businesses that merely provide the pipes of the internet, that want to
turn those pipes into a battleground of who can pay the most to
transport data along them because the services that run along them are
now infinitely profitable.

ok so your sort of on the right track, but i think you need to more carefully examine the traffic shaping policies of the major players. for example, traffic shaping is NOT in place on the highest two packages from virgin media, (well it is in the second highest, but only on upload and only between 4pm and 9pm and you have to upload around 3GB first so...)
i think that is perfectly fair, if i want to use bittorrent (which i do, a lot) then i should have my services limited to some degree unless i am willing to pay extra to have those limits removed (which i have) i now have a 50Mbit internet downlink and a 5Mbit uplink, which is completely unlimited (except for said upload limit, which is fair tbh... anyone uploading 3GB in 5 hours is overdoing it a little) and if i wanted to upload more, i chuck another 5 or 10 pounds per month into my account and the upload limit is removed as well as doubling my downlink speed...
while i agree that net neutrality is important, hitting out at a few large companies who do infact have a very good network (virgin media are doing ANOTHER round of infrastructure upgrades at the minute) and its just people who want the cheapest option to be the fastest...

I totally agree that users should be expected to foot the bill for this, and all your costs you mention, but they shouldn't be all footed by the highest bandwidth users, or for it to be seen like it is them that is causing all these added costs. Of you list of electricity costs of the datacentre, the cabling to your door, the programming, the router, the modems, the building rent for the datacentre, staff wages, tech support. testing and maintenance, virtually none of that is dependant on bandwidth usage ; switches in the datacentre require power regardless of usage, the cabling needs laying regardless of traffic, programmers do their job regardless of how much their software is used, building rent, staff wages, tech support (argueably this is more likely to be used by low usage people..) all need to be paid regardless of how much traffic is passing through the network. Sure, if we all became high bandwidth users then the upgrades, housing etc all go up, but then so should the bill to the users too, across the board and proportionate to the service provided regardless of the cheap part of bandwidth.
The problem is most users dont want to pay more than a few pounds a month for their broadband and the ISP are regulating to match this. Personally I pay for my full bore broadband with Sky with unlimited all round, even though I can only get 4Mbit to my house because when I'm at home, I want to download as much as I want. People are starting to use the service more and more, they need to be fucking charged for that service too.
My gripe is mainly don't offer a fucking service of unlimited this, full speed that etc and then complain when people use that. I just want a clearer outlay of ISP rules from the off - Virgin do do this, I wish BT would be forced to step in line.
I also wish that cunt from their adverts, and their lies on their fastest wireless broadband puke would die in fires too, but thats another story...
